Getting back on topic, I know I'm late to the party, but I have to speak up.  I raised this over at the same thread topic at TWC Classics, so here I go...

First of all, I don't know how anyone believes this law is a stupid idea.  But it is even more stupid that drivers even think of texting while driving. You might as well give them a friggin' beer, have them drink it and try and drive a straight line.

I believe it will be difficult to enforce the law on those who are texting because unlike talking on the cell phone, you cannot with ease visibly see them doing it as it is when you can see someone holding the phone to their ear.  The driver would be looking down while texting.  Why do you think that we are seeing more and more cars being sold where in their commercials, either you can hook up your cell phone to your dashboard for speakphone use or better yet, have voice activation systems included where you can talk?  To entice drivers to stop putting their cell phones to their ears and have two hands on the wheel and two eyes on the road while driving.

Al, how do you not need your eyes to text?  That makes no sense.  Unless you're one of the best typists in the country, I cannot see how this is possible especially while driving.

The bottom line is, like drunken driving, talking on cell phones and text messaging while driving causes accidents. That's what is at stake here.  Some of them can be fatal.  I've seen reports far too often of accidents happening as a result of an idiot chatting on their cell phone and yes, even texting.

If people are that friggin' lazy to get themselves a hands-free kit or pull over to the side of the road to text, then they shouldn't be driving.  Then again, that's the problem.  People are too distracted, too preoccupied with other things while driving.  Hard to believe that there are people that actually groom, eat meals, do makeup, read newspapers or anything else while driving AT THE SAME TIME!  I've seen it with my own two eyes.

Should these laws be enforced?  darn right they should.  Recently, I was late to work because of an accident that I later learned was caused by a driver that was talking on their cell phone.  Again, I'm sure the police will find an effective way to catch offenders, but we aren't fully aware of what methods they are besides the obvious.

And even with a hands-free kit, you're still NOT paying 100% attention to the road. The human brain cannot focus on two things completely, at the same time. I don't care how well people think they can drive while talking on their cell phone or using a bluetooth, etc. headset. People NEED to be 100% focused on the road, AT ALL TIMES. :yes: If you drive while talking or texting on your cell phone, you're just setting yourself up for an accident. And that is not acceptable. :no:

I agree with you that you as a driver aren't paying 100% attention to driving while using a hands-free kit, Stephen. But it's significantly safer than without it.

Another thing to consider.  Putting a cell phone to your ear to talk and texting on highways (such as Interstates) as opposed to local secondary roads is even worse because the accident risk is higher with the higher traveling speeds and increased possibility of severe injury or fatalities.  The risk is higher in more congested traffic zones as opposed to lighter volume areas.

The sad part of this whole debate on this issue is, there are so many countless drivers that are irresponsible on the road even for simple things such as cell phone/text messaging use as they drive, there is the need for state law enforcement.  I don't mind the cell phone being used if you are in transit, but not at the exact same time you're driving.  Pull over somewhere if there is the need to talk or text.

Maybe a handful of you have never experienced life without cell phones in our society, but it hasn't been that long since that was the case.  But if we survived back then without cell phones, I'm sure for the short time you're on the road, we can still survive the need to talk on one while driving.

The sad fact is, many people seem to "not be able to live without" cell phones, because I notice a lot of people using them during school and on the bus (which isn't allowed on either) all the time. I have a feeling that will be the same case when those people start to drive, too. <_<

They should ban cell phones altogether. Are they really that necessary? No. In fact, they are unnecessary. We've lived without them up until the 90s or so, we can certainly do it now..

I have to disagree with one thing Paul said, and that's that hands free talking is significantly safer. That's actually not true. It's actually only marginally safer, at best. No method of talking can change the fact that your attention is going to be on the discussion your having and not on the road. Even if you have both eyes on the road, your mentally not looking at the road.

Even if your talking to another person in the car, its still just as distracting (well, maybe not as much) using a cell phone.

Even if you have the so-called "talent" to text while driving, its completely impossible to have your full concentration on the road. Not sure what it's going to take to get that through your head...

ok guys, you know what? ask me if i care? because truthfully, i don't...if you all HAD social lives, you'd know there is such talent, and you would also know how hard it is to not talk/text on the phone....as for gil, I already cleared that up, i know it STILL takes some distraction away from the driver. i don't know why you insist on bring back what was already settled.
